PART D: SHORT ESSAY (Three paragraph)

Question 1

Danny Presti owns a bar on Staten Island, a borough of New York City. Mr. Presti has been arrested twice for allegedly violating Gov. Andrew Cuomo’s Corona Virus restrictions. The restrictions provide that only outdoor and take-out service is permitted in restaurants and bars in the State of New York during the COVID-19 Pandemic, however, Mr. Presti has ignored the guidelines and has served customers indoors.

Mr. Presti was released on bail and organized a protest meeting with his supporters at the bar, which amounts to another violation of the restrictions. The bar was packed with people drinking and singing and yelling curses against Gov. Cuomo. In fact, there were so many people inside the bar that the number of occupants exceeded the number of people allowed pursuant to the Certificate of Occupancy issued to the premises.

The New York City Police Department (NYPD) came to the bar and arrested Mr. Presti again, along with two other people, Tony Salerno and Liza Luciano, who have been charged with assaulting a police officer. All three defendants have been indicted (formally charged by a grand jury). The arrest took place on February 12, 2021 and the indictment was issued by a Grand jury in Richmond County on March 17, 2021.

In a three-paragraph essay, explain whether the charges against Presti, Salerno and Luciano should be dismissed. Make sure you explain your decision.

Question 2

Should the death penalty be imposed on people who commit premeditated murder under the influence of drugs or alcohol? Some people believe that the death penalty should not applied in such cases because the defendant is not in control of his/ her actions. Other people believe that the death penalty is appropriate in such cases because even though the defendant is not in control of his/her or action, he/she made a conscious decision to use drugs or alcohol in the first place. A third group of people believe that the death penalty should never be imposed, regardless of the circumstances, because it is cruel and inhuman, and it may be applied to people who are innocent.

State your position clearly from the very beginning of your essay. Also explain the reasons for your position on the issue. You will be graded on the basis of the clarity and coherence of your essay regardless of your position on the issue. Three paragraphs will suffice.
