What function does the system of tort law serve in our society . . . what are its goals?  Assume that one of your nurses administers the wrong drug to a patient in your hospital with severe adverse results and the patient brings a claim for negligence against your hospital and the nurse.  Analyze and explain the elements which must be proven by the patient to succeed in a claim based in negligence and any defenses the hospital and/or the nurse might have to the claim of negligence.Explain informed consent. Do you believe it is important?  Why or why not?  Describe the nature and extent of the information a patient should legally be provided prior to undergoing a risky procedure in order for consent to be informed – be sure to consider both the objective and subjective aspects of informed consent.  Also address any possible concerns with the patient’s ability to comprehend the information given and how this issue is addressed. How does informed consent relate to the concept of autonomy?Discuss the ethical concerns encountered in the allocation of scarce health care resources. Describe and apply the concepts learned in our consideration of ethics in this course in explaining how you would allocate such scarce resources and the factors that you would find important to your decision.  For instance, how do you think the COVID vaccine should have been allocated and administered from an ethical point of view?  What would be your goals?  How would you achieve them?Explain the concept of euthanasia. Describe the difference between active and passive euthanasia giving examples. Describe the difference between voluntary, nonvoluntary, and involuntary euthanasia.  What is the possible legal effect of each?Describe the necessary elements to create a valid and binding contract, the remedies for the nonperformance of a contract and any defenses to the nonperformance of a contract. Why is it important that the governing body of a hospital approve the appointment and reappointment of physicians to the medical staff? What process would you recommend?  Why? What is the National Practitioner Data Bank and how might it be useful in this process?  7.  What is the most important thing you learned this semester?  Share with me what it was and why it was important to you and how you think it will assist you in the future.   8.
